Terms of Service — Good Move Daily

Good Move Daily is operated by 3Cups Pty Ltd of Melbourne, Victoria, Australia (“we”, “us”, “our”). These Terms govern your use of the Good Move Daily iOS application. By downloading or using the app, you agree to be bound by them.


1. Not Medical Advice

Good Move Daily is a wellness companion. It is not a medical device, and nothing it tells you is medical advice.

The daily readiness scores, guidance, and AI-generated messages the app produces are based on patterns in your Apple Health data and general wellness principles. They are not medical diagnoses, clinical recommendations, or substitutes for professional healthcare.

Before you change your exercise routine based on the app’s guidance — whether it tells you to push harder or to rest — please consult a qualified healthcare professional, particularly if you:

  • Have a pre-existing medical condition
  • Are recovering from illness, injury, or surgery
  • Are pregnant or postpartum
  • Are new to regular exercise

Do not ignore medical advice or delay seeking it because of anything Good Move Daily tells you.

If you are experiencing a medical emergency, call emergency services immediately. In Australia: 000. US: 911. UK: 999. Or your local emergency number.

We are not liable for any injury, adverse health outcome, or consequence arising from your use of or reliance on the app. See Section 8 (Limitation of Liability).


2. About the Service

Good Move Daily reads your Apple Health data — including step count, sleep, workouts, active energy, and heart rate — and uses it to calculate a daily readiness score that tells you whether to push or rest today, and what that means in practice.

Free tier: Your daily readiness summary, calculated on-device.

Plus tier: Everything in the free tier, plus an AI-generated daily message written specifically for you. The Plus tier sends a selection of your recent health data to Anthropic’s Claude API to produce this personalised message. By subscribing to Plus and using this feature, you consent to this transmission. See our Privacy Policy for full details.

The app is designed for personal, non-commercial use only.


3. Eligibility

You must be at least 13 years old to use Good Move Daily. If you are under 18, you should have parental or guardian consent before using the app.

The app is designed with adults in mind. Its readiness guidance is calibrated to active adults; it may not be appropriate for children and is not intended for them.


4. Subscriptions and Billing

The free tier of Good Move Daily is available at no charge. The Plus tier is a paid subscription purchased through the Apple App Store.

Billing: Your subscription is billed to your Apple ID account at the price and frequency shown before you subscribe.

Auto-renewal: Your subscription automatically renews for the same period at the end of each billing cycle, unless you cancel at least 24 hours before the renewal date.

Cancellation: To cancel, go to iOS Settings › [Your Name] › Subscriptions › Good Move Daily and follow Apple’s cancellation instructions. You can also visit support.apple.com/HT202039. Cancelling stops future renewals; you retain Plus access until the end of your current paid period.

Deleting the app does not cancel your subscription. You must cancel through your Apple ID settings.

Refunds: Refund requests are handled by Apple under their own policies. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com.

Price changes: We will notify you of any change to subscription pricing before it takes effect. Continued use of the Plus tier after a price change constitutes acceptance of the new price.

Free trials: If a free trial is offered, it will convert to a paid subscription at the end of the trial period unless cancelled beforehand.


5. Acceptable Use

Good Move Daily may only be used for its intended purpose: personal daily wellness guidance. You agree not to:

  • Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the app
  • Copy, redistribute, or resell any part of the app or its content
  • Use the app in any way that violates Australian law or the laws of your jurisdiction
  • Use the app to facilitate harm to yourself or others
  • Attempt to interfere with the app’s functionality or any services it connects to (including Anthropic’s API)
  • Use automated tools to access or interact with the app in ways we haven’t authorised

We reserve the right to suspend your access if you breach these terms.


6. Intellectual Property

Good Move Daily, including its name, design, readiness scoring methodology, copy, graphics, and all other content, is the property of 3Cups Pty Ltd or its licensors. All rights reserved.

“Good Move Daily” is an unregistered trade name of 3Cups Pty Ltd. These Terms do not grant you any right to use our name, branding, or logo.

Your licence to use the app is personal, non-exclusive, non-transferable, and revocable. It ends when you delete the app or if we terminate your access under these Terms.


7. Disclaimer of Warranties

To the maximum extent permitted by law, Good Move Daily is provided “as is” and “as available” without any warranty of any kind, whether express, implied, or statutory.

We make no warranty that:

  • The readiness scores or AI-generated messages will be accurate, complete, or appropriate for your individual circumstances
  • The app will be uninterrupted, error-free, or free of bugs
  • Health data from consumer devices is inherently precise; the app’s recommendations reflect this

This disclaimer does not affect any rights you have under Australian Consumer Law or other mandatory laws — see Section 9.


8. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any injury, illness, adverse health outcome, or physical harm arising from acting on Good Move Daily’s guidance.
  • We are not liable for any indirect, incidental, special, or consequential loss — including loss of data, loss of earnings, or economic loss — arising from your use of the app.
  • Where our liability cannot be excluded, our total liability to you for any claim is limited to the amount you paid for the app or your Plus subscription in the 12 months preceding the claim.

Nothing in this clause excludes liability for death or personal injury caused by our negligence, or for fraud.


9. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any similar State or Territory legislation that cannot lawfully be excluded.

Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to re-supplying the service or paying the reasonable cost of having the service supplied again.


10. Termination

By us: We may suspend or terminate your access to Good Move Daily at any time, with or without notice, if you materially breach these Terms. If we discontinue the app entirely, we will endeavour to give reasonable advance notice via the App Store or an in-app message. For active Plus subscribers, Apple manages refunds for unused periods in accordance with their policies.

By you: You may stop using the app at any time by deleting it. If you have an active Plus subscription, remember to cancel it separately through your Apple ID settings before deleting the app.

Sections 1, 6, 7, 8, and 9 survive termination.


11. Governing Law and Disputes

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of laws principles.

Any dispute arising from these Terms or your use of Good Move Daily that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

If you are a consumer in the European Union or another jurisdiction where mandatory consumer protection laws apply, nothing in these Terms affects your right to rely on those protections or to bring proceedings in your country of residence.


12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via an in-app notice or App Store update notes before the change takes effect. Continued use of the app after updated Terms are posted constitutes your acceptance.
